Terms of Service & Operating Philosophy

Welcome to SPLASHYSTUDIOS LLC and The Splash Club.

This document serves two purposes:

• the legal terms you agree to by using our platforms
• a clear statement of how and why this space exists

By accessing or using any SPLASHYSTUDIOS LLC platform — including SplashyRecords.com, The Splash Club, splashBB, or related domains — you agree to these terms.

1. What This Is

SPLASHYSTUDIOS LLC is an independent creative studio and software company.

The Splash Club is its public forum layer — a place for text-based discussion, promotion, and publishing that prioritizes visibility over virality and structure over algorithms.

We provide the platform.
We also actively drive traffic to it.
This is intentional.

2. Accounts & Identity

• Use one account and use it honestly.
  You’re free to choose your username, alias, branding, or project name, as long as it’s not offensive or misleading.

• No manipulation.
  Multiple accounts used to game visibility, ratings, or discussion are not allowed.

• No automation.
  Accounts must be operated by a human. Bots, scripts, or automated posting are prohibited.

You are responsible for all activity on your account.

3. Content Ownership & Licensing

• You own what you post.
  SPLASHYSTUDIOS LLC does not claim ownership of your content.

• License to display.
  By posting publicly, you grant SPLASHYSTUDIOS LLC a non-exclusive right to host, display, and distribute your content solely for operating and promoting the platform.

• Public posts are persistent.
  Threads and comments are intended to remain part of the public record.
  Some edits or deletions may be limited to preserve discussion context.

Post intentionally.

4. Content Visibility & Moderation

We do not rewrite history, but we do manage discovery.

• Content that violates guidelines or lowers overall signal quality may be:
  • marked as spam
  • hidden from public feeds
  • restricted from discovery

Spam-marked content remains visible on the author’s profile.

Moderation decisions are manual and contextual, not algorithmic.

5. Membership & Access

• Reading is public.
  Anyone can view public threads and pages.

• Participation is gated.
  Posting, commenting, and certain interactions require an active Splash Club membership.

• Fees.
  Membership fees grant access, not ownership or control of the platform.
  Payments are final unless otherwise required by law.

If an account is closed or removed, public content may remain visible to preserve discussion integrity.

6. Promotion & Linking

Promotion is allowed and expected.

However:

• links should include context
• posts should add substance
• repetitive or low-effort promotion may be marked as spam

This platform is a broadcast tower, not an ad feed.

7. Acceptable Use

You agree not to post or engage in:

• hate speech, threats, or targeted harassment
• impersonation or deceptive behavior
• illegal, pornographic, or exploitative material
• content designed purely to provoke or disrupt discussion

We reserve the right to act when behavior undermines the purpose of the platform.

8. Privacy & Data

• We collect only what’s necessary to operate the service (account data, content, basic analytics).
• We do not sell user data.
• We do not run third-party behavioral advertising.

If you close your account, identifying information may be removed, but public content may remain visible for archival and contextual reasons.

9. Platform Availability

All SPLASHYSTUDIOS LLC platforms are provided as-is.

We make no guarantees regarding:

• uptime
• availability
• data permanence beyond reasonable effort

We may modify, pause, or discontinue features at any time.

10. Enforcement & Termination

We may issue warnings, restrict access, or permanently remove accounts for violations of these terms or the Community Guidelines.

Enforcement is based on behavior and impact, not ideology or popularity.

11. Updates to These Terms

These terms may evolve as the platform evolves.

When changes are significant, we’ll make a reasonable effort to communicate them publicly.

Continued use of the platform constitutes acceptance of updated terms.

12. The Operating Philosophy

We believe:

• discussion should be readable
• promotion should be honest
• visibility should not depend on timing or outrage
• algorithms are not neutral
• slower systems produce better signal

These terms exist to support that belief — not to pretend neutrality, and not to scale chaos.
